TERMS & CONDITIONS

(Comprehensive Unified Agreement)

This Rental Agreement (“Agreement”) governs all rentals from Joy Ride Adventures LLC (“Company,” “we,” or “us”). By booking, paying for, signing for, or operating any rental vehicle, the Renter/Driver (“Renter,” “You”) agrees to all terms outlined below.

**1. Eligibility Requirements. - **To rent or operate a Polaris Slingshot, you must:

• Be at least 21 years of age;

• Present a valid, unexpired driver’s license;

• Pay with a valid, bank-issued credit or debit card in your name (no prepaid or cash cards).

Failure to meet these requirements results in immediate cancellation without refund.

**2. Company Right of Refusal - **Joy Ride Adventures reserves the right to refuse service or cancel any rental at its sole discretion for any reason, including but not limited to:

• Suspicious or high-risk behavior;

• Incomplete or unverifiable documentation;

• Use of fraudulent, unverifiable, or ghost/virtual payment methods;

• Safety concerns, intoxication, or unsafe conduct.

If refusal is triggered by renter behavior or unacceptable documentation, no refund is guaranteed.

**3. Booking Fees (Non-Refundable). - **All booking fees are strictly non-refundable under all circumstances, including weather changes, schedule conflicts, cancellations, or no-shows.

**4. Ghost Card and Virtual Payment Policy **To ensure chargeability for damages and fees:

• Virtual cards, masked numbers, temporary or disposable cards, ghost cards, Apple/Google Pay masked numbers, and Privacy.com numbers may require an additional authorization hold.

• The name on the card must match the renter’s ID.

• A physical, bank-issued credit or debit card may be required.

• Joy Ride Adventures reserves the right to decline virtual or ghost cards entirely.

• If a valid physical card cannot be presented when requested, the booking may be canceled with no refund.

5. Security Deposit Authorization Hold

A temporary authorization hold (“deposit”) is required before the rental begins. This is not a charge. Deposits are contingent on the vehicle returning in the exact condition it left. Deposit release requires:

• On-time return;

• No new damage;

• No mechanical, cosmetic, wheel, tire, or interior damage;

• No missing items (helmets, keys, accessories);

• No excessive dirt, fluid spills, smoke odors, or debris;

• No policy violations;

• No delays affecting subsequent rentals.

If damages or violations occur, the deposit may be partially or fully retained. Additional charges may apply if damages exceed the deposit amount.

**6. Vehicle Condition Documentation. - **Joy Ride Adventures documents vehicle condition using:

• Check-in photos before departure;

• Check-out photos upon return.

These photos establish the official condition of the vehicle. The renter agrees to return the vehicle in the same condition. Any discrepancies are the renter’s responsibility.

**7. Responsibility for All Items. - **The renter must return all items in the same condition received:

• Vehicle;

• Keys;

• Helmets;

• Accessories;

• Safety equipment.

Missing or damaged items will be billed at their replacement cost.

**8. Fuel Policy (93 Octane Required). - **The renter must use 93 Octane Premium gasoline only. The vehicle must be returned with a full tank. If not full, a $40 refueling fee will be charged.

**9. Rental Timing and Late Fees. - **Your rental period begins at the scheduled start time and ends at the scheduled return time.

Late Return Rules:

• Returns more than 1 hour late are considered “Late Returns”;

• Late Returns are billed at $99 per hour;

• If your late return interferes with or cancels the next reservation, you may be billed the full daily rate for the missed booking;

• Time delays resulting in business interruption are fully billable.

**10. Weather Policy - **The renter is responsible for checking weather conditions before booking. Joy Ride Adventures is not responsible for weather changes, rain, temperature drops, visibility issues, or renter preference changes.

Weather does not qualify for refunds. Reschedules may be considered based on availability.

**11. Adventure Assure Coverage Limitations. - **Polaris Adventure Assure provides ride-experience coverage only and does not cover:

• Vehicle damage of any kind;

• Exterior panels, body components, frame, or interior;

• Wheels, rims, tires, suspension, or alignment damage;

• Aftermarket components or accessories;

• Cosmetic or structural damage.

The renter is fully liable for any damage not covered by Adventure Assure.

**12. Prohibited Use and Restricted Operation. - **The renter agrees not to:

• Drive off-road or on unpaved surfaces;

• Drift, burnout, stunt, race, or operate the vehicle recklessly;

• Drive under the influence of alcohol, drugs, medication, or impairing substances;

• Engage in illegal activity while using the vehicle;

• Use the vehicle for commercial, delivery, or ride-share purposes;

• Allow unapproved persons to drive;

• Exceed vehicle limitations or use it in any unsafe manner.

Violation of these terms voids all coverage and results in full renter liability.

**13. Authorized Driver Requirement. - **Only the renter listed on this Agreement may operate the vehicle unless a secondary driver is explicitly approved in writing by Joy Ride Adventures.

Unauthorized drivers void coverage and create full renter liability.

**14. Smoking, Vaping, and Substance Policy. - **Smoking, vaping, or use/possession of illegal substances inside or near the vehicle is prohibited.

Violations may result in a cleaning fee starting at $250, plus damage, odor removal, or replacement costs as necessary.

**15. Mileage, Speeding, and Road Violations. - **The renter is responsible for any citations, red-light violations, speeding tickets, tolls, or legal penalties incurred during the rental.

An administrative processing fee may be added for handling such matters.

**16. Towing, Impound, Recovery, and Abandonment. - **If the vehicle is towed, seized, impounded, abandoned, or requires recovery for any reason, the renter is responsible for:

• All towing and recovery costs;

• Impound fees;

• Storage fees;

• Administrative processing fees;

• Lost rental revenue due to downtime;

• Damage resulting from abandonment or improper parking.

**17. Accident and Incident Responsibilities. -**In the event of an accident, the renter must:

• Notify Joy Ride Adventures immediately;

• Call police and file an official report;

• Not abandon the vehicle;

• Provide all requested documentation and cooperation with insurance and claims processes.

Failure to comply voids coverage and results in full renter liability.

**18. Indemnification Clause. - **The renter agrees to indemnify, defend, and hold harmless Joy Ride Adventures LLC, its owners, employees, contractors, and affiliates from any claims, demands, losses, damages, liabilities, injuries, citations, or legal actions arising from the renter’s use or operation of the vehicle, including third-party claims.

**19. Assumption of Risk. - **The renter acknowledges that operating an open-air vehicle involves inherent risks and voluntarily assumes full responsibility for personal injury, property damage, vehicle damage, or loss arising from rental or operation of the vehicle.

20. Cancellation and Gift Card Policy

**Cancellations Less Than 72 Hours (3 Days) Before Rental. - **If cancellation occurs less than 72 hours prior to the rental time:

• The full rental amount will be charged;

• No refunds will be issued;

• Joy Ride Adventures may, at its sole discretion, issue a gift card for future use, but issuance is not guaranteed.

**Cancellations More Than 72 Hours (3 Days) in Advance - **If cancellation occurs more than 72 hours prior:

• Booking fees remain non-refundable;

• Eligible rental or insurance fees may be refunded only as a Joy Ride Adventures gift card;

• No cash or card refunds will be issued.

Gift Card Terms

Gift cards:

• Have no cash value;

• Are non-transferable;

• Must be used before the expiration date provided;

• Cannot be used, reinstated, extended, or replaced after expiration.

**21. No Refund Policy. - **All payments to Joy Ride Adventures LLC are non-refundable, including:

• Booking fees;

• Rental fees;

• Deposits;

• Weather-related cancellations;

• Schedule conflicts;

• No-shows;

• Right-of-refusal cancellations caused by renter circumstances.

**22. Financial Liability for Damage, Delays, and Downtime -**The renter is fully financially responsible for:

• All vehicle damage;

• Damage to wheels, tires, or suspension;

• Missing equipment or accessories;

• Labor and repair costs;

• Cleaning fees;

• Fuel fees;

• Late-return fees;

• Lost rental revenue due to downtime;

• Any charges exceeding the deposit amount.

The renter authorizes Joy Ride Adventures to charge any card on file for all amounts owed.

**23. Charge Authorization - **By booking or operating the vehicle, the renter expressly authorizes Joy Ride Adventures LLC to charge any card on file for:

• Rental fees;

• Late fees;

• Fuel charges;

• Damage costs;

• Missing items;

• Towing, recovery, impound, or administrative fees;

• Any amount owed under this Agreement.

**24. Chargeback and Dispute Policy - **Initiating a credit card chargeback or bank dispute after services have been rendered is a breach of this Agreement. The renter agrees to resolve all disputes directly with Joy Ride Adventures prior to contacting their financial institution.

**25. Severability - **If any portion of this Agreement is deemed invalid, the remaining provisions will continue in full force and effect.

**26. Governing Law and Venue -**This Agreement is governed by the laws of the State of Georgia. All legal disputes shall be resolved exclusively in Cobb County, Georgia.

**27. Agreement to All Terms - **By booking, paying, signing, or operating a Joy Ride Adventures vehicle, the renter certifies that they have read, understood, and agreed to all terms in this Agreement without exception.
